On February 6, 2001, RIBO's executive met with Dina Palozzi and her staff from the Financial Services Commission of Ontario (FSCO) to discuss the issues affecting the regulatory environment and to explore ways of improving the regulation of financial intermediaries. At this point, our discussions are in the preliminary stages. We will update you as the process moves along.

The same week Council and senior staff met for our annual strategic planning session. We reviewed current regulations and discussed the state of the industry. Our objectives during these discussions have always been to allow brokers to remain competitive and stay on a level playing field, while at the same time protecting the consumer. RIBO realizes that we must be flexible and respond quickly if necessary to changes in our environment, while maintaining our mandate of consumer protection. We welcome your comments regarding any regulatory concerns you may have.

This issue of the Bulletin includes some very exciting news. As you'll read, we compared the AIIC/CIP and CAIB programs with our broker skills requirement for the "Unrestricted -Technical Only" registration. I'm happy to announce that Council has approved the use of the AIIC/CIP and CAIB designation as an equivalency for the "Unrestricted - Technical Only" class of registration. If you qualify, please see page 7.

Also in this issue is an article on incorrect and correct handling of line-of-credit transactions, a case example of a broker's misappropriation of trust funds (From the Files) and two inserts. The first insert is an update on the Insurance Information Centre of Canada's (IICC) Uninsured Vehicles Project. The other insert is a copy of the Revised Marketing Practices Guidelines. Please read this document carefully and if you have any questions or concerns, please do not hesitate to call RIBO for clarification.

I hope everyone is now looking forward to spring. After the winter we've had, I know I am.

Over the last few months the Qualifications and Registration Committee and staff have reviewed and finalized a few items on our agenda. It is my pleasure to update you on our progress.

I would like to refer you to our article on accepting AIIC/CIP and CAIB equivalency for Unrestricted-Technical-Only registration. We are very pleased to be announcing this exciting news in recognition of your achievements in furthering your education.

Over the last few months we have received requests for permission to delete the Y2K extension endorsement, also known as "the misinterpretation of dates endorsement," from brokers' Errors and Omissions policies. After consultation, the Council has decided that this must remain as part of the E & O policy.

We have also received inquiries from brokerages regarding extended maternity leave to 52 weeks with respect to individual continuing education requirement must be met. The requirement must still be met since it is a condition of licensing. May we suggest that plans be made to complete the current year and the following year's requirements prior to the last day worked. There are also a number of providers that offer courses over the Internet, allowing the individual to complete the requirement at home. Please refer to the latest Continuing Education Summary or our Website for a full listing of accredited providers.

I would also like to clarify a couple of items. I'll begin with Secondary Business. RIBO Regulation 991 Section 5 (1) (b) stipulates that an individual's only business or employment must be that of an insurance broker. The Qualification and Registration Committee must approve any other occupation except that of a life insurance agent. An individual who invests in another business but is not involved part in the day-to-day running of that business does not require an exemption. For further clarification please contact Margaret Walcott or Vivian Lee.

It is also the responsibility of each individual and brokerage firm to notify RIBO of any changes to their original or renewal application within 30 days. This would include, but is not limited to, changes in employment, name, address, principal broker or share structure.

Over the last three months we reviewed 20 requests for secondary business exemptions of which four were for the sale of mutual funds, RRSPs, RESPs, etc. We also reviewed three requests to waive the examinations for an "Unrestricted" registration of which one was granted and two received proposals to refuse. On December 13, 2000, the Committee held a hearing regarding a proposal to refuse an application for a certificate of registration based on the grounds that the applicant did not meet the suitability requirements for qualification as a broker. The proposal to refuse was based on a disclosed prior criminal conviction for employee fraud of approximately $700. The committee considered the circumstances under which the offence was committed, the time elapsed since the conviction, the applicant's rehabilitation efforts and the attendance in support of the application of the responsible supervising broker from the applicant's prospective brokerage. Upon hearing the evidence, the Committee ordered that with certain restrictions the application was not barred by reason of the conviction.

From the Files

The broker was a 20-year employee of the brokerage entrusted with the duties of daily bank deposits and month-end reconciliations. When a client paid in cash, the broker did not include the money in the deposit but adjusted the 90-day-account-receivable list to reflect that the client had paid. Eventually this resulted in a cash flow problem for the brokerage.

Motivation for employee theft varies. In some instances the principal broker is aware that the employee has fallen on hard times. They will even loan them money and are truly sympathetic over the broker's predicament. Misappropriation of trust funds should be reported to RIBO immediately.

Line Of Credit Transactions

As a result of several recent cases at discipline committee meetings and our ongoing spot-check process, we have noted an increasing number of "line-of-credit" transactions where an end-of-the-month transfer in, is followed by a first-of-the-month transfer out of the trust account.

INCORRECT handling of trust monies - The following example assumes a broker using line-of-credit transactions. Typically, if a day's deposit of trust funds was $10,000, $9,000.00 would be transferred to the general account. From there the broker's bank would automatically reduce any outstanding amount on the line of credit. That broker would then draw on the line at the end of the month and transfer these funds into the trust account so that the brokerage appears to be in compliance with regulations on the last day of the month. Other brokers do not go to these extremes; they will make a deposit into the trust from the general account at month's end and transfer the same or a different amount out of the trust the first business day of the next month. In either of the above cases, the brokerage in question is probably in a trust deficit on all days of the month except one.

CORRECT handling of trust monies - Ontario Regulations require brokers to deposit funds received from the public immediately (no later than three banking days) into the trust account. Brokers may take monies belonging to the brokerage and deposit them into the general account but they must leave the remaining balance in the trust account according to the terms and conditions upon which the funds were received. The brokerage must be in a trust positive position at all times and over 90 day balances are excluded as a trust asset in this calculation. Consequently, the brokers in the scenarios referred to above are likely in noncompliance with the regulations pertaining to the handling of trust monies.

Please refer to the Practice Advisory June 2000 Bulletin (also on Website) pertaining to the "three-step approach." This approach allows a broker to answer the question, "what's mine and when can I take it?" If followed, the member will be in full compliance with the above regulations.

Additional Consideration ("Line-of-Credit" Scenario)
A broker that had taken a long-term debt or structured his debt in another way will likely find the interest saving insignificant in comparison to avoiding the potential disciplinary actions.

RIBO requires a financially oriented individual. The salary range is $45,000 -$55,000, depending on experience and qualifications. Office experience in an insurance brokerage is an asset.

Responsibilities:

  • Assist registrants in accounting and trust fund matters.
  • Analyze financial positions and ensure compliance with regulations.
  • Perform on-site corroboration of financial reports.
  • Assess new business registrations.
Qualifications and Experience:
  • A designation or fifth level standing in a recognized accounting program, preferably with audit experience.
  • Good communications skills and an ability to deal with the membership. Travel by personally owned automobile required.

DISCIPLINE COMMITTEE'S DISPOSITION (10/30/00)
  • The Discipline Committee accepted the plea of guilty of Mr. Hainer personally and on behalf of Insuranceland Inc. to the alleged misconduct.
  • The Discipline Committee was satisfied that the problems had been rectified, and accepted the submission as to penalty from RIBO and Mr. Hainer, and ordered:
    1. That Insuranceland Inc. shall file with RIBO monthly position reports in Form-1 for a period of 2 years, all of which position reports must reflect that the brokerage is maintaining its net trust position in compliance with ss 16(4); 16(5); 16(6) of Ont. Reg. 991.
    2. That Insuranceland Inc. shall pay a fine in the amount of $1,500.00, payable to the Ministry of Finance.
    3. That failure by Mr. Hainer or Insuranceland Inc. to comply with the terms and conditions of the Order of the Discipline Committee shall result in the Certificate of Registration of Mr. Hainer being restricted to acting under supervision.

PARTICULARS OF THE COMPLAINT

  • Pursuant to a prior Order of the Discipline Committee of RIBO, the Certificate of Registration of Mr. Procop was suspended for the period August 20, 1999 to July 31, 2000.
  • Mr. Procop, during the period of suspension was engaged in the selling of Accident and Sickness Insurance policies, and continued to act otherwise in soliciting, negotiating or procuring the making of other contracts of insurance, while not legally competent to do so.

  • The Discipline Committee found Ronald Procop guilty of the alleged misconduct.

PARTICULARS OF THE COMPLAINT

  • Mr. Wright was involved in a dispute over an endorsement to a commercial client's insurance policy. The client requested a cancellation of the policy and was advised by Mr. Wright that the policy would be cancelled flat.
  • Mr. Wright then invoiced the client for a $500.00 service fee which was not disclosed to the client prior to the service being rendered.

  • Mr. Lawrence was the Principal Broker of Pro Insurance Brokers and as such was responsible for the supervision of all registered insurance brokers employed by the brokerage.
  • As a result of a prior Order of the Discipline Committee of RIBO, Ronald Procop, a registered insurance broker and former Principal Broker of Pro Insurance Brokers had his Certificate of Registration suspended.
  • During the period of the suspension, Mr. Procop continued to carry on business as a registered insurance broker at Pro Insurance Brokers.
  • Mr. Lawrence as Principal Broker of Pro Insurance Brokers failed in his duty to prevent this unauthorized practice by Mr. Procop.

  • The Certificate of Registration of Donald C. Lawrence was restricted to acting under supervision, effective December 7, 2000.

In Memoriam

It is with deep regret that we note the sudden passing of Fred McLean (Moore-McLean Corporate Insurance Ltd. of Toronto). Fred served as a broker volunteer on RIBO's Complaints Committee continuously since 1989, serving most of those years as Chair. His distinguished contribution on behalf of Ontario brokers was much appreciated. He will be greatly missed.

We are pleased to announce that Council has approved the use of the AIIC/CIP and CAIB designation as an equivalency for the "Unrestricted - Technical Only" class of registration subject to the following conditions:

  • The designation must have been attained within the past five years.
  • We must receive dated documentation confirming completion of the designation. (Individuals with AIIC/CIP must also provide a copy of their transcript to verify sufficient commercial lines exposure).
  • We must receive a letter of support from your Principal Broker.

Reminder: Retail Sales Tax

Effective April 1, 2001 the Retail Sales Tax on automobile insurance will be reduced from 4% to 3% on all premiums due April 1, 2001 and later.

Please note that this tax reduction is on automobile premiums that were previously taxed at 4%.
