In the past three months, I was fortunate enough to represent RIBO at several broker conventions and industry events in several areas of the province. Meeting and speaking directly with brokers at these events offers us tremendous value because of the insight we gain into the issues concerning brokers in these particular regions. I thank those who invited us and encourage any other groups to contact us if you would like us to attend your upcoming event. IMPORTANT ISSUE This is a very important edition of the Bulletin because it contains the 2002-2003 fee structure, information on the renewal process and a nomination form for RIBO Council Election. Continuing Education Also included in this issue, is a copy of the Continuing Education Summary for each individual member. Once again, this includes an overview of the entire program. Please keep this in your records for future reference. I encourage everyone to get their hours done early to avoid any suspensions of licensing. Unlicensed Intermediaries Another item of great importance is the article Important Notice: Unlicensed Intermediaries (Wholesalers) reminding brokers that it is their responsibility to thoroughly investigate any unlicensed intermediary (wholesaler) prior to placing any business with them. RIBO Election Like each year, there are three seats on RIBO Council up for election this fall. The commitment currently required of a successful candidate averages about one to two days a month and includes service on one or more sub-committees of council. All council members participate in the Qualification and Registration Committee, which usually meets before the monthly board meeting on the second Wednesday of each month. Travel and overnight (if necessary) expenses are covered by RIBO and each director receives a per diem for meeting days. There may be the occasional month when there are two meetings, however this is a rare occurrence. In addition to regular board meetings, some directors sit on a complaint panel, requiring them to attend two to three hearings a year. Nomination details are provided in this issue along with highlights of the specific regulatory requirements. These requirements are taken directly from the regulations to the RIB Act. All nominations are due at the RIBO office no later than 4 p.m. on September 16. A photograph and a brief biography of no more than 100 words should also be included with your nominations. Qualification and Registration Report
Art LangleyChairperson Once again renewal season is upon us. It is every individual´s responsibility to ensure your license is renewed. If you have not received your wallet certificate by October 10th, please contact the RIBO office. If your registration should be lapsed for non-renewal, a penalty fee of $125, in addition to the normal reinstatement and registration fee, must be paid. This costly penalty can be avoided by ensuring that your application reaches us before the August 31 deadline. Brokers who allow their registration to expire may also lose any grandfather rights. The other important deadline to ensure continued compliance and avoid suspension of your license is to make sure your continuing education requirements have been met by September 30. If you live in a remote area and/or have Internet access, consider taking one of the Internet courses listed in the continuing education summary. On the subject of continuing education, I would like to clarify a few points on the Quebec-Ontario Reciprocity Education Agreement. Ontario brokers must fulfill the full Quebec 30-hours within the two year period. Your RIBO credits (with the exception of Ontario Legislation) can count towards the Quebec requirements. RIBO will accept the ChAD accredited courses with the exception of Quebec laws. The reciprocity agreement between RIBO and FSCO is still not finalized. We will keep you posted on this subject. Please take the time to read the article on unlicensed intermediaries. I urge you to protect your clients during this difficult marketplace. Over the last three months we´ve had 36 requests for secondary business. All were granted. The exemption breakdown was as follows: 15 individuals were granted exemptions to sell financial products, 21 individuals were granted other secondary business exemptions. There were no requests to waive the Level I or Level II exams. If RIBO staff or I can be of any assistance over the next few months, please do not hesitate to contact us. Important Notice: Unlicensed Intermediaries (Wholesalers) RIBO advises brokers to proceed with extreme caution when using unregulated intermediaries. Because Ontario does not require wholesalers to be licensed (the only province in Canada), it is necessary to exercise the appropriate diligence when investigating the credentials of unlicensed and unregulated intermediaries (wholesale brokers) before you place any business with them. We suggest you use our online database to check for registration, contact your local association, or if possible, get a list of reputable references. It is your professional responsibility to ensure you provide your clients with the appropriate customer care. If placing business with an unlicensed insurer, please ensure that you comply with Regulation 991, Section 10, and have your client read and sign the unlicensed insurance client consent form. Penalty Fee Brokers who allow their registration to lapse are required to pay a $125 penalty fee to have their license reinstated. This is in addition to the registration and reinstatement fee. Good News: Fee Discount RIBO Council is pleased to announce that it is in a financial position to offer an early payment discount off the registration fee, largely as a result of maintaining efficient operations. RIBO will allow a $25 early payment reduction in the 2002-2003 renewal fee for all RIBO members, both individuals and firms. Please note that this is a one time only reduction and that payment must be received by August 31, 2002 in order to qualify. Deadline For Renewal Applications August 31, 2002
Renewal applications for all active individuals and firms will be forwarded to the address of the brokerage firm. Principal Brokers must make sure renewal applications are distributed to all brokers operating in or outside of the main office. It is the Principal Broker´s responsibility to ensure that the renewal application forms for their business are properly completed and submitted on time. In addition, they are expected to ensure that all individual brokers associated with the brokerage firm comply with the continuing education requirements and renew their registration. It remains the responsibility of each individual member to ensure that his or her registration is renewed. Please contact RIBO if you do not receive your renewal application form by July 31, 2002. Below are the categories for registration renewals: Sole Proprietors, Partnerships & Corporations: The renewal form must be completed and signed by the Principal Broker. For Partnerships and Corporations, any changes to share information or partners not previously reported, must be presented at this time. Individuals: All individuals must complete and sign the renewal form. Please make sure that the continuing education question is answered in order to confirm compliance. "Inactive": Brokers registered as "inactive" must renew their registration and complete their continuing education requirement in order to maintain their status. Forms will be mailed directly to the address RIBO has on file. Please make sure that RIBO has your current address on file. Non-Active Firms: All Non-Active Firms will receive an application to renew their registration. PLEASE NOTE: Cheques may be post-dated up to August 31, 2002. Notice Of Election Of Council Members
Notice is hereby given that the annual election of council members will be held on Monday, November 4, 2002 at which time three council members are to be elected for a term of three years. Registrants have the opportunity to nominate candidates, including incumbents if they agree to have their names put forward for election to serve another term. A nomination form with instructions was enclosed in this edition of the Bulletin. Eligibility for election is set out in RIBO By-law No. 21, Section 1 (2) as follows: Each person who is an individual member of the corporation (RIBO) and,
is eligible to stand for election to the Council in accordance with this Regulation. Nominations must be received in writing by the Manager at the RIBO office no later than 4:00 p.m., on September 16, 2002. In early October, each registered insurance broker will receive a list of nominated candidates, including a brief biography (100 words) outlining their professional qualifications and record of community service. The nomination sheet will be accompanied by a ballot form and a return envelope to be delivered to the RIBO office to the attention of the Manager, no later than 4:00 p.m. on the date of the election, November 4, 2002.
