FSRA has released their approved auto policy forms to align with Government’s amendments to the Insurance Act – Insurance Act, R.S.O. 1990, c. I.8 (ontario.ca) and related regulations to now include electronic communication and pre-paid courier as valid notices of termination of auto insurance contracts. Please visit FSRA’s website for the updated and approved auto policy forms. These changes have come into effect on January 1, 2022.
Acceptable notice now includes electronic communication and pre-paid couriers with certain conditions. For electronic communication, the insured must consent to delivery by electronic means. For pre-paid couriers, there must be a record by the person who has delivered it that the notice has been sent. It is RIBO’s recommendation that brokers utilize further methods of communication along with the formal cancellation notice.
Brokers should be reasonably satisfied that they have knowledge that the consumer has received the notice and that the consumer is aware of the policy cancellation.
RIBO highly recommends that brokers become informed of these important amendments and incorporate these amendments in your office procedures when handling policy terminations.
